General Terms and Conditions

These rules define the principles of making purchases in the online store www.hannastyle.eu.

  1. The owner of the online store is the company "Hanna Style" Hanna, Sławomir, Maciej Nowak s.c. 62-052 Komorniki, ul Żabikowska 61 NIP: 777-288-18-37 REGON: 300213436, e-mail address: esklep@hannastyle.eu, phone: (+48)728 811 950, (+48)61 8108124; fax: (+48)61 622 98 28 located at hannastyle.eu, hereinafter referred to as the Store conducts sales of goods via the Internet. Placement and confirmation of an order are tantamount to acceptance of these Terms and Conditions of Purchase, voluntary purchase of the ordered goods, and consent to processing of the Consumer's, KPPK's and KP's personal data by the Seller for the purposes of carrying out the order. Personal data are not disclosed to other entities for marketing purposes. Placed order constitutes a purchase agreement in the meaning of the Civil Code.

  2. The Consumer of the online store is a natural person.

  3. KPPK (Customer Entrepreneur on the rights of the Consumer) is a natural person who has a business not related professionally to the subject of the e-store.

  4. KP (Customer Entrepreneur) - is a natural person who has a business related professionally to the subject matter of the e-store.

  5. The subject matter of the hannastyle.eu e-shop is women's, men's and children's underwear and thermal clothing, sportswear.

  6. Orders can be placed 24 hours a day, 7 days a week throughout the whole year (Technical breaks are allowed, excluding the store from receiving and processing orders from Consumers, KPPK and KP). Orders placed by Consumers, KPPK and KP are processed on weekdays (excluding days when the store’s warehouses are closed) usually within 24 hours from order confirmation by the Consumer, KPPK and KP or from the moment of Consumer, KPPK and KP full order’s completion by the Store and/or when the full payment for the order is booked by the Shop.

  7. Shop consumers may be persons who are at least 13 years old. (C. C. Art. 11-24) If this condition is not respected the contract is not binding.

  8. Placing an order by the Consumer, KPPK and KP shall be understood as adding products to the Shop Cart from the Store offer by completing an "Order Form" in accordance with the information provided in the above form. Consumer, KPPK and KP can place an order by contacting the Store via e-mail or by phone.

  9. Shortly after placing an order Consumer, KPPK and KP receives information via e-mail about accepting the order for processing (list of selected products, delivery address, order value, method of payment, method of shipment). If such information is not received the Consumer, KPPK and KP should contact the Store by phone or e-mail. The Store reserves the right to confirm acceptance of the order by phone or e-mail, negative verification may result in order cancellation by the Store. The Consumer, KPPK and KP is informed about changes in the status of their order by e-mail.

  10. The Store asks the Consumer, KPPK and KP to provide the correct contact details - especially name and surname, full e-mail address and phone number - when placing an order and during communication with the Shop. Incorrectly filled registration forms can make it difficult or impossible to complete the order.

  11. The Store reserves the right to verify the order in cases where there are doubts about the possibility of order realization and its cancellation in the absence of payment for the order.

  12. Payment for ordered products can be made on delivery (with the courier INPOST or DHL, GLS, DPD), by paying with DOTPAY and by bank transfer to the account of Hanna Style Hanna, Slawomir, Maciej Nowak s.c. Forms of payment are described on the page "Methods of payment".

  13. The order realization begins:

1. in the case of orders payable on delivery - after placing the order,

2. in the case of orders payable by bank transfer - after the prepayment is booked into the Store account,

3. in the case of orders paid by DOTPAY – in the moment of payment authorization.

If the payment is not settled within 14 days from the date of the order, the Store reserves the right to automatically cancel the order.

  1. In case some products are unavailable in the order the Consumer, KPPK and KP are informed by the Store about the status of the order. The Consumer, KPPK and KP may then decide how to fulfil the order (partial fulfilment, waiting time extension, entire order cancellation)

  2. The time needed for ordered products to reach the Consumer, KPPK and KP consists of the completion of the goods and the time needed for the Polish Post / courier / parcel service InPost to deliver the consignment to the address specified by the Consumer, KPPK and KP, but only working days are taken into consideration. All products offered in the Store are brand new and free from physical and legal defects except for products belonging to the outlet tab.

  1. Time of receipt = time of completion + delivery time

  2. On the day the order is shipped, the Consumer, KPPK and KP is informed in an email that the order status has changed to "Shipped".

  1. For sales promotions and clearance sales there is a limited number of goods. Orders are processed within the order of receipt of confirmed requisitions. If the stocks covered by this form of sale are empty, the Store reserves the right for corrections and to contact the Consumer, KPPK and KP or to cancel the order.

  2. All prices visible at the Store’s website are provided in Polish zloty and are gross values (including VAT). These prices do not include flat-rate shipping costs.

  3. A detailed list of the shipment together with a list of costs shall be issued for each order and attached to the shipment of goods ordered by the Consumer, KPPK and KP. The Consumer, KPPK and KP have the right to request that the detailed list of contents is not included in the shipment. We issue VAT invoices on the individual request of the Consumer.

  4. The Consumer, KPPK and KP can cancel the order by phone or e-mail at esklep@hannastyle.eu until the order is sent for shipment by the Store.

  5. In the case of orders consisting of several goods, and to be delivered in one shipment, delivery time will depend on the date of completion by the Store of the last element of the order, unless the Store and the Consumer, KPPK and KP jointly decide otherwise.

  6. Delivery of an order is carried out by shipping ordered goods to the address indicated by the Consumer, KPPK and KP through available shipping services (carrier), such as the Polish Post Office / courier company / InPost parcel machines. The shipping cost is added to the order per shipping cost table. In accordance with the "Civil Code" act in the event of sending an item sold through a carrier, the Consumer, KPPK and KP is obliged to check the condition of the consignment upon receipt. In the event of loss or damage to the goods one must make all the necessary steps to determine the liability of the carrier, informing the Store. The way of examining a shipment is regulated in the Transport Law (article 74 and following). The legislator provided that acceptance of the consignment by the recipient (Consumer, KPPK and KP) without reservations causes expiration of claims for loss or damage to the consignment.

  7. Orders are shipped in Poland and Europe (excluding countries such as France, Germany, Great Britain, Bulgaria, Switzerland, the Netherlands and Belgium - due to the sale of Hanna Style products in those countries by its business and trade partners who offer the same products on their local sales portals).

  8. Shipping cost in Poland for Inpost parcel machines is 12,99 PLN in case of prepayment, and 14,99 PLN in case of cash on delivery. The cost of shipping by courier is 18,99 PLN in case of prepayment and 20,99 PLN in case of cash on delivery.

  9. The cost of shipping within Europe is in line with the following price list, received from the DPD courier company:

  1. The Consumer and KPPK, who has concluded a remote contract has the right to withdraw from it within 14 calendar days without giving any reasons, making a statement to the Store in writing. The fourteen-day period in which the Consumer and KPPK may withdraw from the contract is counted from the date on which the goods were delivered. Sending the statement before the deadline is sufficient to meet this deadline. Exemplary declaration of withdrawal can be downloaded here (click).

  2. In case of withdrawal from the contract, the contract shall be considered as not concluded and the Consumer and KPPK shall be released from any obligations. What the parties have provided shall be returned in an unchanged condition, unless the change was necessary within the limits of ordinary management. The return is possible only if the goods bear no signs of use, are complete and have not been damaged in any way. Together with the returned goods the Consumer and KPPK are obliged to return all products. Attaching a sales document to the package will be appreciated. The return of the goods should be made immediately, no later than within fourteen calendar days. Consumer and KPPK cover the costs of returning the goods.

  3. The Store is liable under the warranty, when the product sold by the Store is affected by a defect (defect - reducing the value of the product, the usefulness of the product, when the product does not have the properties described on the website of hannastyle.eu , when the product was issued in an incomplete state), and at the time of arranging the contract the Consumer and KPPK did not know about it. The condition to maintain the right to make a complaint is a written notice of defect on the appropriate form available on the website hannastyle.eu, within 1 month from the date of its discovery. Under the warranty, the Consumer and KPPK have the right to: withdraw from the contract, reduce the price, replace the defective item with another, without the defect, remove the defect. The complaint will be considered by the Store within 14 days from the date of receipt of the faulty product together with the required documents. In case of the necessity of issuing an expert's opinion, the time of handling the complaint may be extended to 21 calendar days.

  4. The Store makes every effort to ensure that product descriptions presented on the website are as accurate as possible. However, in case of any doubts please contact us by phone or email at esklep@hannastyle.eu before placing an order.

  5. The Store is committed to protecting personal data in accordance with the Act of August 29th, 1997 on the Protection of Personal Data (Journal of Laws 1997 No. 133 item 883). Per this act Consumers, KPPK and KP of the Store have the right to inspect their data, correct them, demand their removal or stop using them.

  6. 28th The shipment costs in the case of goods replacement resulting from incorrect order realization by hannastyle.eu is covered by the Store in the limit of the amount given below. Shipping costs to Hanna Style Hanna, Sławomir, Maciej Nowak s.c. shall be covered by the Consumer and KPPK. In case of mistake the Store will reimburse the Consumer and KPPK the cost of shipment to the Store in the amount resulting from consignment note and not exceeding 16.90 PLN (in words: sixteen zlotys 90/100). At the same time the Store informs that it does not accept any parcels sent back to the Store paid upon delivery or via Inpost parcel machines.

  7. In case of paid order, when the Store is unable to carry out the order in full, the Store informs the Consumer, KPPK and KP about this fact. In case of resignation of the missing item or the whole order the Store returns the prepayment to the bank account given by the Consumer, KPPK and KP within 5 working days counted from the date of cancelling the order or its correction.

  8. Information provided in the Store does not constitute an offer within the meaning of Article. 66 of the Civil Code; it is an invitation to conclude a contract within the meaning of Article. 71 of the Civil Code.

Exchanges, Claims, Returns.

EXCHANGE

  1. In order to exchange the purchased goods, the Customer needs to pack the products and send them back to the address: Hanna Style s.c, Żabikowska 61 Street, 62-052 Komorniki

  2. Please be advised that we do not accept any packages sent back to the Store with cash on delivery and into parcel machines.

  3. Please include a copy of the receipt, which was received with the goods.

Please also include the completed exchange form.

  1. The exchange form can be downloaded here (click) or generated through the Customer panel. The Customer covers the shipping costs.

  2. In the case of replacement of the goods purchased by the Consumer or KPPK for a different size or assortment when there’s no Store’s fault, the Consumer or KPPK shall bear the cost of sending the replacement goods to the Consumer or KPPK, in accordance with paragraphs 12, 21, 22. Please indicate the type of settlement and form of shipment on the replacement form. If the value of the exchange order exceeds the value of the returned products, Customer Service will inform about the amount of the surcharge.

  3. Please pack the returned goods carefully, in a way that will protect them from damage during transport. Bras, swimsuits should be sent back in a hard cardboard box. Goods damaged during shipment as a result of improper protection by the Consumer and KPPK are not subject to return/exchange. Goods which will not be exchanged (sent back after the due date, without tags or box, dirty, damaged) will be sent back at the expense of the Consumer or KPPK, after contacting the Consumer or KPPK and trying to solve the problem.

  4. Possibility of the replacement of goods expires after 14 calendar days from the day on which you acquire possession of the goods or on which a third party other than the carrier and indicated by you acquires possession of the goods.

  5. The products in the OUTLET zone cannot be exchanged - these are second quality products without tags.

Claims

  1. To make a complaint, please fill out the form: here(click).

  2. Goods, if possible, with a copy of the receipt received and completed complaint form should be sent to the address: Hanna Style s.c, 61 Żabikowska Street, 62-052 Komorniki

  3. The complaint will be reviewed by the Store within 14 days from the date of receipt of the complaint product with the required documents.

  4. In case an expert's opinion is necessary, the deadline for complaint handling may be extended to 21 calendar days.

  5. We would like to inform you that we do not accept any packages sent back to the Store by cash on delivery or to parcel machines.

  6. The Internet store Hanna Style s.c. in accordance with applicable rules of the Civil Code (Article 556- 576, Journal of Laws of 18 May 1964 No. 16 item. 93, as amended), and the Act of 27-07-2002 on the specific conditions of consumer sales and amending the Civil Code (Official Gazette of 5 September 2002 No. 141 item. 1176) will consider complaints within 2 years from the date of purchase of the article. If this period is exceeded, the rights are lost, which means that the Store will not be held responsible. Notifying the Store is the only obligation of the Consumer and KPPK, therefore it is important to submit a complaint in writing to prove the fact of notifying the Seller in case of any doubts. The Store bears liability under warranty if the goods sold are affected by a defect (defect - reducing the value of the product, the usefulness of the product, when the product does not have the properties, described at the store Hanna Style s.c., when the product was delivered incomplete), and at the time of the agreement the Consumer or KPPK did not know about it. The condition to maintain the right to make a complaint is to attach a written notice of defect on the appropriate form available on the website hannastyle.eu, within 2 months from the date of its discovery and return the product. Under the warranty, the consumer has the right to: withdraw from the contract, reduce the price, replace the defective item with another without defects, remove the defect.

  7. The products in the OUTLET zone are not subject to complaint - these are second quality products without tags, and the information about their defects is given in the description of each specific product.

Returns

  1. The period for resignation expires after 14 calendar days from the date on which the Consumer or KPPK has gained possession of the item or on which a third party other than the carrier and indicated by the Consumer or KPPK has gained possession of the item.

  2. To use the right of resignation, the Consumer or KPPK must inform us of their decision to withdraw from this contract by an unequivocal statement (for example, by letter sent by post, telephone information or e-mail), tel: +48 728 811 950, e-mail: esklep@hannastyle.eu, and then send the goods back to the address indicated below:

  1. The Consumer or KPPK may use the example resignation form or generate one from the customer service panel after logging in.

  3. In order to comply with the withdrawal period, it is sufficient for the Consumer or KPPK to inform us about the exercise of his right of withdrawal before the end of the withdrawal period.

  4. Products in the OUTLET zone are not subject to resignation - these are second-quality products, damaged, without tags, at symbolic prices, of which the Customer is informed during purchase and in the offer in the Store, and which the Consumer or KPPK buys at his/her own risk.

Consequences of resignation

  1. In the event of resignation from this contract, we shall return to the Consumer or KPPK all payments received from the Consumer or KPPK, including the delivery costs of the item to the Consumer or KPPK, promptly and in any event no later than 14 days from the day on which we are informed of the withdrawal from this contract.

  2. We will refund the payment using the same means of payment used by the Consumer or KPPK in the original transaction, unless the Consumer or KPPK has expressly agreed otherwise; in any event, the Consumer or KPPK shall not incur any fees in connection with such monetary refund.

  3. Please send back or hand over the goods to us immediately and in any case not later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if the Consumer or KPPK sends the goods back before the expiry of the 14-day period.

  4. The Consumer or KPPK shall bear the direct costs of returning the goods. The consumer or KPPK shall be liable only for the diminished value of the goods resulting from using it in a manner other than that necessary to ascertain the nature, characteristics and functioning of the goods.
